We now have the name of the man who was killed after being struck by a state police cruiser on Kirkwood Highway.

He is 49-year-old Robert Smith of Wilmington.

Police say Smith was likely drunk as he tried to cross Kirkwood Highway near Farrand Drive in Marshallton and was struck by the marked police car.

Smith was pronounced dead at the scene.

State Police have not identified the trooper, but say he's a 43-year-old man assigned to Troop 6 in Prices Corner.

Kirkwood Highway was shut down in the area of the accident for more than three hours. It's since been re-opened.
