Gun ban in public housing areas heads to Del. SupCo

A federal appeals court has sent a case involving the Wilmington Housing Authority's ban on guns in common areas back to the Delaware Supreme Court.

A three-justice panel of the U.S. Third Circuit Court of Appeals in Philadelphia certified a question of law to the Delaware court on July 18. Delaware Supreme Court formally agreed to hear the question of law Tuesday.

The News Journal reports a federal judge ruled last year that the housing authority can prohibit from displaying or using a gun in public areas. Two residents had challenged the rule.

Both sides must now file briefs with the Delaware Supreme Court.
